Client’s situation
Lionel is an EU citizen, from France. He has been working and living in the UK since 2012 and left the UK to France in 2015. By the end of 2020 he decided to return to the UK and did not apply for EUSS status as he was thinking that he is from the EU and can live and work in the UK. However he did not consider that the Immigration Law of the UK for all nationals has been changed starting from the end of 2020.
After December 2020 he entered the UK according to Family Permit for 6 months as his partner and child were living in the UK and they were holding EU pre-settled status. However, again Lionel did not apply for EU pre-settled status because he just did not know that he had to apply for pre-settled status after arriving to the UK according a Family Permit visa.
Solution and result
In June 2023, he asked me for immigration advice. LawSentis for him was to make EUSS Late Application for Pre-Settled Status as he has all necessary evidence that he was living and working in the UK before December 2020.
He got the successful decision on 11 September 2023.
